EU legal guarantee notice on Etsy: what Etsy does for you

From 27 September 2026 traders selling goods to EU consumers have to display the EU's harmonised legal guarantee notice. I covered the what and the why in the EU legal guarantee notice explainer. This post is the Etsy version, because Etsy has now said how it will handle it, and the answer is "mostly for you, with a catch".

In short

Etsy displays the notice automatically on relevant listings for buyers in the EEA, in the applicable language, if your shop is set as a trader.

Check your trader status. Business sign-ups are set as traders automatically. Etsy links the notice to that setting, so do not expect it on a shop set as a private seller.

New listing fields cover commercial guarantees and the GARAN label. Fill them in only if you offer a guarantee beyond the legal one.

The confirmation email is the gap. Etsy does not say the notice goes in it. A line in your Message to Buyers narrows that gap.

Same directive, same day: vague green claims like "eco-friendly" are restricted in listings aimed at EEA buyers.

What Etsy has said

The EU legal guarantee notice is a fixed Commission graphic that reminds buyers of their legal guarantee rights, and from 27 September 2026 traders selling to EU consumers must display it.

Etsy published a help article on the EU Empowering Consumers for the Green Transition Directive, the directive behind the notice, most recently updated on 15 September 2026. The key line for physical items:

If you are a trader, the EU harmonised notice will automatically surface, in the applicable language, on applicable listings of items marketed towards EEA buyers.

Etsy adds that you will be notified "as part of the listing creation process" when the notice will surface on a listing. The EEA is the EU plus Iceland, Liechtenstein and Norway.

Two other lines in that article matter just as much. Etsy calls it "a practical guide based on our interpretation" and not legal advice, and says "sellers remain responsible for the accuracy and compliance of their listings". So Etsy is doing the display. Getting your inputs right is still yours.

Step 1: check your trader status

Everything hangs on this. Etsy shows the notice for shops it has down as traders.

If you signed up on Etsy as a business seller, Etsy has set you as a trader automatically.
Any shop can update its trader status in its policy settings, at any time.

Whether you are a trader is a legal question, not an Etsy one. Etsy itself calls it "complex" and recommends advice tailored to your business. A rough guide: if you make or buy items to sell them regularly, for income, you are very likely a trader. The risk runs one way. A shop that is really a business but is set as a private seller should not expect the notice to appear, and it still owes it.

Step 2: watch for the notice when you create a listing

Etsy says it tells you "as part of the listing creation process" when the notice will surface. So the simplest check is to start a new listing for a physical item you ship to the EU and look for that message. If you are set as a trader and you see nothing, contact Etsy Support, which is what Etsy's article suggests for questions about how the notice appears.

Step 3: the guarantee fields, only if you offer more than the law

Etsy has added fields for extra guarantee information. Leave them empty if all you offer is the legal guarantee.

Commercial warranty or guarantee terms. If you offer any guarantee beyond the legal one, its details go here.
GARAN label. If you are the maker (the producer) and your guarantee is free, covers the whole item and lasts more than two years, it qualifies for the EU GARAN label. You enter the duration, your brand name and the item's model identifier, and Etsy surfaces the label on the listing. Etsy is explicit that you are responsible for the accuracy of what you enter.

If your shop promises a "lifetime guarantee", read does your lifetime guarantee need the GARAN label before touching the GARAN field. The label takes a number of years, and "lifetime" is not one.

The same section of Etsy's article mentions repair, spare-parts and after-sales information, "if applicable to your item". Unless you offer repairs or after-sales service, most jewellery, clothing and home decor will not need it.

Step 4: one line in your Message to Buyers

The Commission's practical guidelines say "the harmonised notice should also be included in the confirmation email". Etsy's article talks about listings and does not mention the confirmation email, and you cannot put the notice graphic into Etsy's email yourself.

What you can add is text. Etsy's Message to Buyers is "a short note you can include in the receipt page and order confirmation email". Where: Shop Manager, Settings, Info & Appearance, Message to Buyers. Add:

Your legal guarantee rights: if you are in the EU, you have a legal guarantee on the goods you buy. Find out more at europa.eu/youreurope/guarantees

That address is the English destination of the notice's QR code, and I checked it resolves. I have left the length of the guarantee out of that wording on purpose: it can vary by country, and for second-hand goods some countries allow it to be shortened to one year.

Be clear about what this does. It narrows the email gap. It does not put the notice itself in the email. If Etsy adds the notice to its confirmation emails later, this line becomes a harmless extra.

Step 5: check your returns wording against the guarantee

While you are in your policies, read your returns wording next to the notice. The right of withdrawal and the legal guarantee are different things. Refusing a change-of-mind return on a personalised piece can be fine. Refusing a remedy for a faulty one is not, and from 27 September your EU buyers see a notice telling them so.

Step 6: your green claims, same directive, same day

This is the part of Etsy's article most sellers will miss, and it lands on the same date. For listings aimed at EEA buyers, Etsy says these are generally prohibited:

generic terms like "eco-friendly", "green" or "sustainable", unless backed by recognised excellent environmental performance,
offset-based claims like "carbon neutral" or "net zero", and
claims about your whole shop that only apply to some items.

Etsy's suggested fix is to be specific (its example is "100% recycled cotton"; for a jeweller that might be "recycled sterling silver") and to keep records that back it up. Three more points from the same article:

Ticking an Etsy material attribute like "Recycled Glass" or "Plastic-Free" counts, in Etsy's words, as certifying the item meets it and that you hold the supporting documents.
If you mention a certification such as GOTS or RCS, which clothing sellers often do, it has to be current, cover that specific item, and come from a scheme that meets the directive.
Etsy "may remove or restrict listings" it becomes aware of that do not comply.

Search your titles, tags, descriptions and shop announcement for the generic words before 27 September.

FAQ

Does Etsy add the EU legal guarantee notice for me?

For shops set as traders, yes. Etsy says the notice surfaces automatically, in the applicable language, on relevant listings for EEA buyers, and that you are told during listing creation when it applies.

I am not sure if I am a trader. What should I pick?

That is a legal question and Etsy recommends advice tailored to your business. If you sell regularly to make money, assume you are a trader. Setting yourself as a private seller when you are not one does not remove the obligation.

Do I need to upload the notice image to my listings?

Etsy says it displays the notice itself for traders, so no. You would need the image files for your own website.

I am in the UK or the US. Does this apply?

If you sell to consumers in the EU, assume yes. EU consumer law generally attaches to where the consumer is, and no source I reviewed carves out sellers outside the EU.
